Copyright Policy (DMCA)

Food Done Better, LLC ("Food Done Better," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to valid notices of alleged copyright infringement on the Food Done Better platform (the "Platform").


Reporting Copyright Infringement

If you believe that content on the Platform infringes your copyright, you may submit a written takedown notice to our designated DMCA agent. Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  2. Identification of the copyrighted work you claim has been infringed. If your notice covers multiple works on the Platform, you may provide a representative list.

  3. Identification of the material you claim is infringing, including enough information for us to locate it on the Platform (such as the URL of the page where the material appears).

  4. Your contact information, including your full name, mailing address, telephone number, and email address.

  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

We aim to review and act on valid takedown notices within two (2) business days of receipt.


Counter-Notification

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our DMCA agent. Your counter-notification must include all of the following:

  1. Your physical or electronic signature.

  2. Identification of the material that was removed or disabled and the location where it appeared on the Platform before it was removed (such as the URL).

  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your full name, mailing address, and telephone number.

  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Food Done Better may be found), and that you will accept service of process from the person who submitted the original takedown notice or their agent.

Upon receiving a valid counter-notification, we will forward it to the party who submitted the original takedown notice. If the original complainant does not notify us within ten (10) to fourteen (14) business days that they have filed a court action seeking to restrain the infringing activity, we will restore the removed material.


Repeat Infringers

It is our policy to disable access to and/or terminate the accounts of users who are determined to be repeat infringers of third-party copyrights.


Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
