TERMS OF SERVICE

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Food Done Better, LLC, a Texas limited liability company ("Food Done Better," "we," "us," or "our"). These Terms govern your access to and use of the Food Done Better website, mobile applications, and all related services (collectively, the "Platform").
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Platform at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the updated Terms.
IMPORTANT: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 16) THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.
2. Description of Service
Food Done Better is a community-driven discovery platform for local food businesses, including farms, restaurants, markets, grocers, bakeries, and other food-related establishments. The Platform enables users to discover businesses that prioritize transparent practices, honest sourcing, and quality food.
The Platform provides the following features, which may be modified, expanded, or discontinued at our discretion:
- Business and market listings with detailed information about practices, products, and sourcing
- Search and discovery tools, including location-based recommendations
- User accounts with profile management and favorites
- User reviews and comments on business listings
- Business listing claiming and management tools
- Premium membership subscriptions for users and businesses
- An AI-powered chatbot for discovering listings and markets
- Sponsored content and affiliate promotions for food businesses
The Platform is informational in nature. We do not guarantee the accuracy, completeness, or currency of any listing information, nor do we endorse any business listed on the Platform. Listing on the Platform does not constitute a recommendation, certification, or endorsement of any business's food safety practices, sourcing claims, or product quality.
3. Eligibility
You must be at least sixteen (16) years of age to create an account or use the Platform. By creating an account, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.
Paid membership subscriptions require you to be at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater.
If you are creating an account on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" as used in these Terms refers to both you individually and that entity.
4. User Accounts
4.1 Account Creation
To access certain features of the Platform, you must create an account using either an email address and password or through Google OAuth authentication. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@fooddonebetter.com of any unauthorized use of your account or any other breach of security.
4.3 Account Types
The Platform offers different account types, including standard user accounts and business accounts. Business accounts carry additional responsibilities regarding the accuracy of business listing information and authorization to represent the associated business.
4.4 One Account Per Person
Each individual may maintain only one account. Creating multiple accounts is prohibited and may result in the termination of all associated accounts.
4.5 Account Deletion
You may request deletion of your account at any time through your account settings or by contacting us at support@fooddonebetter.com. Upon account deletion, your personal profile information will be removed. However, content you have contributed to the Platform (such as listings and reviews) may be retained in an anonymized form as described in Section 5.
5. User-Generated Content
5.1 Content License
You retain ownership of all content you submit, post, or display on the Platform, including but not limited to listings, reviews, comments, images, and profile information (collectively, "User Content"). By submitting User Content, you grant Food Done Better a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, distribute, and process your User Content for the following purposes:
- Operating, providing, and improving the Platform
- Displaying your User Content to other users of the Platform
- Promoting the Platform and its features through our own marketing channels and social media accounts
- Indexing, vectorizing, and retrieving your User Content to power Platform features, including AI-assisted search and discovery tools
- Generating aggregated, anonymized, or de-identified data and insights
Important: This license does not grant Food Done Better the right to use your User Content to train third-party artificial intelligence or machine learning models. We may, however, process and index your User Content so that it can be retrieved and referenced by AI-powered features within the Platform.
5.2 Content Survival After Account Deletion
If you delete your account, User Content you have contributed (including listings, reviews, and associated images) may be retained on the Platform in an anonymized form. Your display name will be replaced with a generic identifier (e.g., "Community Contributor"), and the content will no longer be associated with your personal information. This retention serves the community interest in maintaining comprehensive and accurate local food business information.
Listings that have been claimed by a different business owner will remain under that owner's management. You may request full deletion of specific content by contacting us, subject to our data retention policies described in our Privacy Policy.
5.3 Content Standards
You represent and warrant that your User Content:
- Is accurate and truthful to the best of your knowledge
- Does not infringe any third party's intellectual property, privacy, or other rights
- Does not contain false, misleading, or fraudulent information about any business
- Does not contain defamatory, harassing, discriminatory, threatening, or obscene material
- Complies with all applicable laws and regulations
- Does not contain spam, solicitation, or unauthorized commercial content
Reviews must reflect genuine, firsthand experiences with the business being reviewed. Listing information must be accurate to the best of the submitter's knowledge.
5.4 Content Moderation
We reserve the right, but are not obligated, to monitor, review, edit, remove, or restrict any User Content at our sole discretion, for any reason, including but not limited to violations of these Terms, applicable law, or our Community Guidelines. We are not responsible for any User Content posted by users.
Users may report content they believe violates these Terms through the Platform's reporting mechanism. We will review reported content and take appropriate action, which may include removal. We may, but are not obligated to, provide an appeal process for content removal decisions.
5.5 Content Responsibility
You are solely responsible for all User Content you submit. Food Done Better does not endorse, verify, or guarantee the accuracy of any User Content. Users should independently verify business information, food safety practices, allergen information, and other claims before relying on them.
6. Listing Claiming
Business owners or their authorized representatives may claim ownership of a listing on the Platform to manage its content. By claiming a listing, you represent and warrant that you are the owner of the business or an authorized representative with the authority to manage the listing.
6.1 Verification
We may require verification of your relationship to the business, which may include email domain verification, phone verification, or documentation of ownership. Verification evidence will be collected, reviewed, and retained in accordance with our Privacy Policy.
6.2 Rights Upon Claiming
Once a claim is approved, you gain the ability to manage listing content, including business information, images, and contact details. Pre-existing community-submitted content may be retained or modified at the claimant's discretion, subject to our content policies.
6.3 Claim Disputes
In the event of competing claims to a listing, Food Done Better will review available evidence and make a determination at its sole discretion. We are not liable for any damages arising from a claim determination, including the approval of a claim that is later found to be fraudulent. If you have questions about a claim dispute, you may contact us at support@fooddonebetter.com.
7. Memberships and Payments
7.1 Subscription Terms
The Platform offers optional paid membership subscriptions for users and businesses. Memberships provide access to premium features as described on the Platform at the time of purchase. You must be at least eighteen (18) years of age to purchase a membership. We reserve the right to modify membership benefits with reasonable notice.
7.2 Billing and Auto-Renewal
Memberships are billed on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will charge the payment method on file for each renewal period. We will provide at least thirty (30) days' notice before any price increases take effect.
7.3 Payment Processing
All payments are processed by Stripe, our payment processor. By purchasing a membership, you agree to Stripe's terms of service. Your payment card information is collected and processed directly by Stripe and never touches our servers. We store only your Stripe customer ID, subscription plan, status, and billing period.
7.4 Cancellation
You may cancel your membership at any time through your account settings. Upon cancellation, you will retain access to premium features through the end of your current billing period. No prorated refunds will be issued for partial billing periods.
7.5 Refund Policy
Refunds may be granted at our sole discretion in cases of billing errors, duplicate charges, or other exceptional circumstances. To request a refund, contact us at support@fooddonebetter.com within thirty (30) days of the charge.
7.6 Taxes
Membership fees are exclusive of applicable taxes. You are responsible for paying any applicable sales tax, use tax, or similar taxes imposed by your jurisdiction.
8. Sponsored Content and Affiliate Relationships
8.1 General
Food Done Better may display sponsored content promoting food businesses with which we have affiliate or referral relationships. All sponsored content is created and managed by Food Done Better. Businesses do not create, submit, or purchase advertisements directly on the Platform. We may earn commissions or referral fees when users take qualifying actions (such as making a purchase) through links or promotions featured on the Platform.
8.2 Labeling
All sponsored content on the Platform will be clearly labeled and distinguishable from organic content using designations such as "Sponsored," "Ad," "Promoted," or "Affiliate." In accordance with FTC guidelines, we disclose our affiliate relationships wherever sponsored content appears.
8.3 Targeting
Sponsored content may be targeted based on general factors such as your approximate location (derived from your IP address or profile hometown), browsing categories, and user type (consumer or business). You may opt out of personalized content targeting through your account settings, as described in our Privacy Policy.
8.4 No Endorsement Guarantee
The inclusion of sponsored content does not constitute an endorsement or guarantee of any business's products, services, food safety practices, or sourcing claims. Users should exercise their own judgment and independently verify information before making purchasing decisions.
8.5 No Guarantees to Affiliate Partners
Food Done Better does not guarantee any specific outcomes, traffic, or conversions to businesses with which we have affiliate relationships.
9. AI-Powered Features
9.1 AI Disclosure
The Platform includes AI-powered features, including a chatbot for discovering listings and markets. When you interact with these features, you are communicating with an artificial intelligence system, not a human. AI-generated responses are clearly identified as such within the Platform.
9.2 Third-Party AI Providers
AI-powered features are provided through our AI infrastructure, which may route requests to third-party large language model (LLM) APIs. Your chat messages and relevant contextual data (such as your location preferences and relevant listing information) may be transmitted to these providers for processing. We review our AI providers' data processing and retention policies to ensure they do not use your data to train their models. For details on how your data is handled, see our Privacy Policy.
9.3 Accuracy Disclaimer
AI-generated responses may be inaccurate, incomplete, or outdated. You should independently verify any information, recommendations, or suggestions provided by AI features before relying on them. AI features do not provide dietary, medical, legal, financial, or other professional advice.
9.4 Prohibited AI Use
You agree not to misuse AI features, including attempting to manipulate the system to generate harmful, offensive, misleading, or illegal content.
9.5 Availability
AI features may be unavailable, limited, or discontinued at any time without notice.
10. Intellectual Property
10.1 Platform IP
The Food Done Better name, logo, design, code, compiled listing data, and all other content published by us on the Platform (excluding User Content) is our property or the property of our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our intellectual property without our prior written consent.
10.2 Data Compilation
While individual facts about businesses may not be copyrightable, the compilation, curation, and organization of listing data on the Platform constitutes our intellectual property.
10.3 Scraping Prohibition
You may not use automated tools, bots, scrapers, crawlers, or any other means to access, extract, copy, or index data from the Platform without our prior written authorization.
10.4 Trademarks
You may not use the Food Done Better name, logo, or any associated trademarks without our prior written permission.
11. Copyright Infringement / DMCA Policy
We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of alleged copyright infringement.
11.1 Filing a Takedown Notice
If you believe that content on the Platform infringes your copyright, you may submit a written notification to our designated DMCA agent containing:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the infringing material and its location on the Platform
- Your contact information (name, address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information in the notice is accurate and you are authorized to act on behalf of the copyright owner

11.2 Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing the information required under 17 U.S.C. § 512(g).
11.3 Repeat Infringers
We will terminate the accounts of users who are determined to be repeat infringers of third-party copyrights.
12. Third-Party Links and Services
The Platform contains links to third-party websites, services, and resources, including links within business listings to external business websites, social media profiles, and map services. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party sites is at your own risk and subject to those sites' own terms.
13. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Creating fake accounts, impersonating others, or misrepresenting your identity or affiliation with any person or entity
- Submitting false, misleading, or fraudulent business information
- Manipulating reviews, including posting fake reviews, purchasing reviews, or engaging in competitor sabotage through reviews
- Circumventing security measures, rate limits, access controls, or authentication mechanisms
- Using the Platform for any illegal purpose or in violation of any applicable law
- Harassing, threatening, or intimidating other users or business owners
- Accessing the Platform through automated means (bots, scrapers, crawlers) without authorization
- Reverse engineering, decompiling, or disassembling any aspect of the Platform
- Interfering with or disrupting the Platform's operations, servers, or networks
- Attempting to gain unauthorized access to any portion of the Platform or other users' accounts
- Using the Platform to distribute malware, viruses, or other harmful software
- Collecting or harvesting other users' personal information without their consent
14. Disclaimers and Limitation of Liability
14.1 "As Is" Disclaimer
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
14.2 Listing Accuracy
We do not guarantee the accuracy, completeness, timeliness, or reliability of any listing information, including but not limited to business hours, product availability, pricing, sourcing claims, certifications, allergen information, food safety practices, or nutritional information.
14.3 Food Safety Disclaimer
FOOD DONE BETTER IS NOT RESPONSIBLE FOR THE FOOD SAFETY, QUALITY, OR ALLERGEN PRACTICES OF ANY BUSINESS LISTED ON THE PLATFORM. Listing information about food practices, sourcing, certifications, and ingredients is user-submitted and not independently verified by us. Users with food allergies, dietary restrictions, or other health concerns should contact businesses directly and exercise their own judgment before consuming any food products.
14.4 No Endorsement
Inclusion of a business on the Platform does not constitute an endorsement, recommendation, or certification by Food Done Better. We do not verify the claims, practices, or credentials of listed businesses.
14.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOD DONE BETTER, LLC AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY USER CONTENT; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (E) ANY OTHER MATTER RELATING TO THE PLATFORM.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
14.6 Service Availability
We do not guarantee uninterrupted, secure, or error-free access to the Platform. We may modify, suspend, or discontinue any part of the Platform at any time without notice.
15. Indemnification
You agree to indemnify, defend, and hold harmless Food Done Better, LLC and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Platform or violation of these Terms
- Your User Content, including any claims that your content infringes third-party rights
- Your violation of any applicable law or regulation
- Your violation of any third party's rights
If you are a business user, you additionally agree to indemnify us against claims arising from the accuracy of your business listing information and your authorization to represent the associated business.
16. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
16.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@fooddonebetter.com and attempt to resolve the dispute informally for at least thirty (30) days. We will likewise attempt to resolve any dispute with you informally.
16.2 Binding Arbitration
If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator in the State of Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
16.3 Class Action Waiver
YOU AND FOOD DONE BETTER AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
16.4 Exceptions
Notwithstanding the above, either party may: (a) bring an individual action in small claims court for disputes within the court's jurisdiction; or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
16.5 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
17. Termination
17.1 Termination by Us
We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or conduct harmful to other users or the Platform.
17.2 Termination by You
You may delete your account at any time through your account settings or by contacting us at support@fooddonebetter.com. Account deletion is subject to the content retention provisions in Section 5.2.
17.3 Effects of Termination
Upon termination:
- Your right to access and use the Platform will immediately cease
- The content license you granted under Section 5.1 will survive for content retained on the Platform
- Any outstanding payment obligations will survive
- Your data will be handled in accordance with our Privacy Policy
- If your account is terminated for cause, no refund of membership fees will be provided
18. General Provisions
18.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Food Done Better regarding the Platform and supersede all prior agreements and understandings.
18.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18.3 Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
18.4 Assignment
We may assign our rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. You may not assign your rights or obligations under these Terms.
18.5 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, pandemics, government actions, or internet or telecommunications failures.
